Terms of sale

This translation is provided for convenience; the French version is the legally binding reference.

ARTICLE 1 – PURPOSE OF THE GENERAL TERMS AND CONDITIONS OF SALE

In the context of the sale of products by IRIS GALERIE, the purpose of these General Terms and Conditions of Sale (hereinafter referred to as the "GTCS") is to inform any potential Customer of the terms and conditions under which IRIS GALERIE carries out the sale and delivery of the products ordered.

These GTCS also set out the rights and obligations of the Parties (the term "Parties" includes the company IRIS GALERIE in its capacity as Seller and the Customer in their capacity as Buyer).

The GTCS apply to all sales of the products offered by IRIS GALERIE within our galleries as well as on our site (https://irisgalerie.com/) and on our mobile application.

As a result, ordering a product offered for sale on the IRIS GALERIE Site or in our galleries entails full and unreserved acceptance of these GTCS, which the Customer acknowledges having read prior to placing their order.

These GTCS also govern the use of the IRIS GALERIE mobile application, accessible via the App Store and Google Play download platforms.

These GTCS are supplemented by the General Terms and Conditions of Use as well as the "Personal Data & Cookies" policy.

ARTICLE 2 – IDENTITY OF THE COMPANY

The company IRIS GALERIE is a simplified joint-stock company, with a share capital of 1,358.50 euros, whose registered office is located at 60 rue de la Boétie in PARIS (75008), registered under number 897 514 618 with the PARIS Trade and Companies Register.

ARTICLE 3 – FORMATION OF THE CONTRACT OF SALE

3.1 - Concept offered

IRIS GALERIE produces photographs of the iris taken from a shot of the Customer's eye. This photograph is then retrieved in order to transform it into a work of art according to the various mediums offered to the Customer.

The shot necessarily requires the Customer to come to one of our galleries. The Customer can locate a point of sale from the "Galleries" tab available on our Site. We therefore require that each person be present at the gallery to have the iris photographs taken.

3.2 - Products offered

The products offered by IRIS GALERIE are as follows:

  • Prints with printing on photo paper that the Customer collects on site at the gallery on the same day;
  • Acrylic glass mediums or aluminium composite panels which can be delivered to the Customer's home or to the gallery;

HD digital formats sent to the email address, which must be provided to the advisor by the Customer. By choosing this type of medium, any printing or other use must be carried out by the Customer themselves. In the event of loss of the digital file, the Customer may request, from the gallery in which the purchase was made, that the file be resent within a period of 3 months upon presentation of the receipt. Beyond this period, no further file will be transmitted. Furthermore, the use of the digital file is intended exclusively for personal use; any commercial use is not permitted.

Jewellery incorporating the Customer's iris are made-to-order pieces. They are produced and dispatched within an estimated timeframe communicated at the time of the order.

The Light Boxes consist of a rigid box and LED lighting. Available in several formats/colours, they are produced and dispatched within an estimated timeframe communicated at the time of the order. Their installation requires a specific connection (see usage appendix in the GTCU).

The Acrylic Blocks are acrylic glass blocks with a representation of the Customer's iris.

The company IRIS GALERIE may also develop any other personalised medium in the future.

The formats available in the gallery range from 15 cm to 180 cm wide, with square, rectangular, in-line or rounded formats.

Depending on the format chosen by the Customer, the latter will have the possibility of including several iris (solo, duo, trio, quartet, quintet, or more on special order with a quote). Depending on the mediums chosen by the Customer, supplements will be offered to complete their order, such as:

  • Classic frames for photo prints;
  • "Classic" or "plus" US boxes intended for professional prints in Alu Dibond or Acrylic.

3.3 - Pricing

The sale prices of the products, in force at the time the order is placed by the Customer, can be consulted on the Site and then in the IRIS GALERIE galleries.

The sale prices of the products may be modified by IRIS GALERIE at any time. This modification will be reported to the Customer before any order.

These prices do not include shipping costs, which are charged in addition to the price of the products purchased. Shipping costs will be indicated before the Customer registers the Order. Only products delivered to the Customer's home require the payment of shipping costs.

The Customer can place an order either at the gallery, or via the IRIS GALERIE website or mobile application.

A price list is provided on the Site in the "FAQ" tab under the "Practical information" heading.

The prices include the value added tax (VAT) applicable on the day of the order. Any change in the applicable VAT rate will be automatically reflected in the price of the products sold by IRIS GALERIE.

Furthermore, the various shipping methods are set out in these GTCS in Article 6 and are also mentioned on the Site. They may be modified at any time by IRIS GALERIE.

IRIS GALERIE also advises any Customer to regularly consult the GTCS appearing on the Site.

ARTICLE 4 – INFORMATION ON GALLERY OPENING HOURS

The opening and closing hours are specific to each gallery. It is therefore the Customer's responsibility to enquire about the hours.

The hours are provided on the IRIS GALERIE website by clicking on the address below https://irisgalerie.com/, under the "Gallery" heading, offering a view of all the existing galleries.

These hours may be subject to slight last-minute changes (public holidays, exceptional constraints, etc.). It is recommended to regularly consult the information online or to contact the gallery concerned directly.

ARTICLE 5 - METHODS OF PAYMENT

5.1 - General information on the method of payment

Payments by bank card and in cash are the only means of payment accepted for the majority of IRIS GALERIE galleries.

However, franchise partners may offer different methods of payment.

5.2 - Accepted bank cards

The bank cards accepted on the Site and in the gallery are as follows: Carte Bleue, Visa, Mastercard.

American Express is excluded.

5.3 - Gift card

IRIS GALERIE offers two types of gift card:

  • The physical gift card;
  • The digital gift card.

The terms of use of these two types of gift card are identical.

The user of the gift card must necessarily come to the gallery to make a purchase.

Indeed, the IRIS GALERIE gift card must necessarily be used at the gallery in a single transaction, which may possibly be supplemented by another means of payment accepted by IRIS GALERIE if the order amount is greater than the initial amount of the gift card.

The gift card cannot be used for the purchase of other gift cards.

The gift card can only be used in the territory in which it was purchased. For example, a gift card purchased in France can only be used in France, and a gift card purchased in Italy is only valid in Italy.

However, some franchise galleries do not participate in the gift card programme. You can contact the gallery by email or telephone beforehand in order to check whether it uses IRIS GALERIE gift cards.

The validity of the gift card is effective from the date of purchase for a period of 1 (one) year. Beyond this period, the gift card can no longer be used.

Furthermore, no replacement or refund is made for the purchase of a gift card, even in the event of loss or theft of the said card.

5.4 - Terms of payment

Any order entails payment.

Consequently, IRIS GALERIE reserves the right to suspend or cancel any fulfilment of an order at the gallery and/or delivery, whatever its nature and level of fulfilment, in the event of non-payment, fraud or attempted fraud relating to the use of the IRIS GALERIE Site or an order placed within our galleries.

ARTICLE 6 - RETENTION OF TITLE

IRIS GALERIE remains the owner of the goods as long as payment is not finalised in full by the Customer.

ARTICLE 7 - METHOD OF DELIVERY AND RECEIPT OF THE ORDER

7.1 - General information

The products ordered by the Customer in accordance with these GTCS will be delivered to the address indicated by the Customer as the delivery address on the relevant order (hereinafter referred to as the "Delivery Address").

IRIS GALERIE also offers, for a selection of products, delivery to the gallery or to the home.

Photo prints are handed over in person to the Customer on the same day as their visit to the gallery; no delivery will be made.

Only prints on acrylic glass or aluminium composite panel, jewellery and light boxes are eligible for delivery. IRIS GALERIE does not provide any hook for fixing the acrylic glass or aluminium composite panel mediums. The choice of fixing is to be arranged by the Customer.

The non-exhaustive list of countries eligible for home delivery is as follows:

Furthermore, since 1 July 2021, all purchases made outside the European Union are now subject to taxation. Thus, for any order shipped outside the territory of the European Union, customs duties shall be borne exclusively by the Customer and shall be their sole responsibility.

7.2 - Confirmation of the order

The order is confirmed as soon as payment is settled.

After providing the elements used for delivery, the Customer will be given at the gallery:

  • A certificate of authenticity;
  • A physical bank card receipt;
  • A summary of the order.

These receipts are to be kept by the Customer. They will constitute proof of purchase and order.

7.3 - Delivery time

The overall timeframe including production and delivery is approximately 15 working days from the visit to the gallery, for deliveries made in European countries.

The remaining countries located outside the European Union generally require a longer delivery time which may sometimes exceed the timeframe mentioned.

Consequently, IRIS GALERIE reserves the right to have a more extended delivery time in order to take into account the destination and the size of the product ordered by the Customer, which may influence the delivery duration.

The Customer is therefore advised to wait within the timeframes mentioned above before making any claim with the Customer Service department.

7.4 - Delivery and receipt of the order at the gallery

Delivery to the gallery consists of the Customer or the recipient of the order coming to collect their ordered and paid-for parcel in one of our galleries eligible for delivery.

To find out which galleries are eligible for in-store delivery, we invite you to consult the list on the IRIS GALERIE site.

The gallery in which the purchase was made by the Customer will be the same location serving the delivery if it accepts deliveries.

If necessary, the Customer may request delivery to a gallery different from the place of purchase of their order (with the agreement of the gallery concerned).

The Customer will be informed by email of the receipt of their order at the gallery by IRIS GALERIE. Upon receipt of the email, the Customer has a period of 30 (thirty) days to collect their parcel.

To collect their order at the gallery, the Customer must go to the gallery chosen for this purpose, bring a valid identity document and the physical or digital receipt containing the summary of the order.

A third party, authorised by the Customer, may also come to collect the Order. To do so, this person must imperatively bring their identity document, a copy of the identity document of the recipient of the order, a power of attorney drawn up by the Customer, as well as a copy of the order summary receipt.

At the time of the handover of the Order, the Customer or the person authorised by the Customer must sign the Order handover slip. This slip serves as proof of delivery by IRIS GALERIE and receipt by the Customer or the recipient of the Order of the products ordered.

No dispute relating to the delivery itself is possible if the parcel appears to have been handed over, the IRIS GALERIE register being authoritative.

7.5 - Delivery and receipt of the order at home

The Customer will be notified by email of the dispatch of the order and will receive a tracking number from IRIS GALERIE. The Customer will be required to track their order. Subsequently, the delivery notification will be carried out directly by the carrier itself.

IRIS GALERIE uses third-party carrier services and does its best to transmit all available information to the Customer. This is why IRIS GALERIE cannot be held responsible for extended delivery times.

In the event of the absence of the Customer or the recipient of the order at the time of delivery, or failing to reschedule the delivery of the order, the delivery person may deposit the order at a pick-up point.

No refund will be made for the payment of delivery costs if the carrier deposits the order at a pick-up point.

An order not collected at the pick-up point will be returned to the laboratory. The Customer may only request the resending of a new order; therefore no refund will be made.

7.6 - Order anomaly

Given the value of the goods and their sensitive nature, the Customer or the recipient of the order is invited to check the apparent condition of the parcel and the products upon delivery.

In the event of an anomaly relating to the order, the Customer or the recipient of the order must imperatively follow the procedure mentioned in Article 7.7.

Failing this, the Customer or the recipient of the order may not claim any replacement of the products in question.

7.7 - Procedure in the event of an order anomaly

It is the responsibility of the Customer or the recipient of the order to report the damage and/or shortcomings observed and to make any claims to the IRIS GALERIE Customer Service department by telephone on +33 (0)1 81 70 19 48 from Monday to Friday from 10 a.m. to 6 p.m. and to send an email to the following address: contact@irisgalerie.com

This email must contain:

  • A photo of the damaged area of the product;
  • A photo of the receipt with the summary of the order.

The notification of incidents must be carried out promptly and at the latest within a period of 3 (three) working days from delivery.

The IRIS GALERIE Customer Service department may request any information relating to the identity of the Customer or the recipient of the order and carry out any useful verification on this occasion.

ARTICLE 8 - IRIS GALERIE RETURN POLICY

No refund is possible due to the unique nature of the product and the laboratory manufacturing method.

Only the resending of a new order may be agreed in the event of damage caused to the product during delivery or for any problems related to delivery. IRIS GALERIE therefore undertakes to resend you your product.

The resending of a new order provides for the same delivery time mentioned in Article 7.3 of these GTCS.

ARTICLE 9 - LIABILITY OF THE CUSTOMER

9.1 - Legal capacity of the customer

Prior to placing their order, the Customer declares that they have full legal capacity, which allows them to enter into commitments under these GTCS. Consequently, IRIS GALERIE cannot in any way be required to verify the legal capacity of its visitors and customers.

Consequently, if a person lacking legal capacity were to order items on the IRIS GALERIE Site or in one of our galleries, their legal guardians would assume full responsibility for this order and shall bear the cost.

9.2 - Limitation of liability of IRIS GALERIE

IRIS GALERIE is not held responsible for damage caused by the Customer or the recipient of the order. Indeed, direct and indirect damage, whether foreseeable or not, caused during the maintenance or fixing of the medium, is the responsibility of the Customer.

No replacement of the product may be agreed.

Furthermore, it is not advisable to hang the works above a bed for safety reasons.

ARTICLE 11 - PROCESSING AND PROTECTION OF THE CUSTOMER'S PERSONAL DATA

IRIS GALERIE collects the Customer's personal data during their visit to the gallery as well as, where applicable, that of the recipient of the order.

All information relating to the collection and processing of data as well as the Customer's rights is set out in the "Privacy Policy" of the IRIS GALERIE website.

ARTICLE 12 - INTELLECTUAL PROPERTY LAW

All the elements present on the site and the site itself are protected by copyright, trademark law, design law and/or any other intellectual property right.

By elements, we mean, on a non-exhaustive basis: photographs, images, drawings, illustrations, texts, videos, logos, trademarks, designs, software, etc.

These elements belong to the company IRIS GALERIE or are used with the agreement of their owners. As such, any reproduction, representation, use, adaptation, modification, incorporation, translation, commercialisation, in part or in full, by any process and on any medium whatsoever (paper, digital, etc.) is prohibited, without the prior written authorisation of the company IRIS GALERIE, apart from the exceptions referred to in Article L122.5 of the Intellectual Property Code, on pain of constituting an offence of infringement of copyright and/or designs and/or trademark, punishable by 4 years' imprisonment and a fine of 400,000 euros.

ARTICLE 13 - APPLICABLE LAW AND COMPETENT JURISDICTION

This contract of sale concluded between IRIS GALERIE and the Customer is subject to French law regardless of the Customer's country of residence and the place where the Order is placed. Any dispute relating to the contract of sale concluded between the Parties shall fall within the exclusive jurisdiction of the French courts..

ARTICLE 14 - DURATION OF THE GTCS

IRIS GALERIE reserves the right to modify these GTCS at any time. However, the GTCS applicable to the contract of sale are those accepted by the Customer at the time the order is placed.

ARTICLE 15 - WARRANTIES

Duration and General Conditions

IRIS GALERIE offers a commercial warranty of 1 year from the date of purchase on:

  • Jewellery
  • Prints on acrylic glass or aluminium composite panel
  • Light boxes

The warranty applies in the event of a manufacturing defect observed by the customer service department, subject to presentation of proof of purchase and appropriate use.

Warranty Exclusions

The following are not covered:

  • Accidents, impacts, crushing, improper handling
  • Exposure to corrosive substances or environments
  • Normal wear or ageing of materials

Conditions of Use

To fully benefit from the warranty, the Customer must comply with the good practices for the use of each type of product. These instructions are detailed in the "Conditions of Use" appendix attached to these General Terms and Conditions of Sale (GTCS).

Failure to comply with these recommendations may void the warranty.

Appendix – Conditions of Use

For jewellery

Avoid contact with:

  • Perfumes, cosmetics, cleaning products
  • Salt or chlorinated water (rinse with fresh water after swimming)
  • Store away from humidity and corrosive agents

For prints on acrylic glass and aluminium composite panel

Do not expose to:

  • UV rays
  • Heat sources (radiators, convectors)
  • Humid environments (bathrooms, cellars, kitchens)

Handle with gloves to avoid scratches

Cleaning:

  • Feather duster or soft cloth only
  • No abrasive or stripping products

Fixing:

  • Securely anchored according to the weight and the wall

Safety:

  • Keep out of reach of children and animals
  • Avoid falls

For light boxes

Instructions for use:

The Light box turns on with a simple short press on the button. A long, continuous press allows you to adjust the brightness according to your preferences. The device retains the last brightness level used and automatically restores it the next time it is turned on. For the 40x40 models, it is imperative to plug them into a wall socket with an amperage of 2.8 A, corresponding to a fast charger, in order to ensure optimal operation.

Do not expose to:

  • UV rays
  • Excessive humidity
  • Direct heat

Handling and maintenance:

  • Gentle dusting, no abrasive products
  • Out of reach of children and animals

Safety instructions:

  • Do not bend or cover the LED strip
  • Unplug if not used for a long time
  • Avoid the accumulation of dust

GTCU

ARTICLE 1 – PURPOSE

The purpose of these General Terms and Conditions of Use (hereinafter the "GTCU") is to define the terms of access, navigation and use of the website https://irisgalerie.com (hereinafter the "Site"), published by IRIS GALERIE SAS, as well as the respective rights and obligations of users and the Publisher in this context.

Access to the Site and navigation on it imply full and unreserved acceptance of these GTCU by the User.

ARTICLE 2 – ACCESS TO THE SITE

Access to the Site is free and unrestricted, subject to any Internet access costs, which remain the responsibility of the User.

The Site is accessible 24 hours a day, 7 days a week, except in cases of force majeure, events beyond the Publisher's control or maintenance interventions necessary for the proper functioning of the Site.

ARTICLE 3 – INTELLECTUAL PROPERTY

The entire Site and its contents (texts, visuals, photographs, videos, illustrations, logos, graphic charters, icons, software, databases, etc.) are protected by the Intellectual Property Code and remain the exclusive property of IRIS GALERIE SAS or its partners.

Any reproduction, representation, distribution, adaptation or exploitation, in whole or in part, without prior written authorisation, is strictly prohibited and is liable to constitute an act of infringement.

ARTICLE 4 – PERSONAL DATA

The personal data collected via the Site is processed in accordance with the Privacy Policy.

In accordance with the General Data Protection Regulation (GDPR), the User has the rights of access, rectification, deletion, objection, restriction of processing and portability of their personal data.

ARTICLE 5 – COOKIES AND TRACKERS

The Site may use cookies and other trackers for technical (proper functioning of the Site), analytical (audience measurement) or advertising purposes.

On the first visit, an information banner allows the User to accept, refuse or configure the use of cookies according to their purpose.

To find out more, the User is invited to consult the Cookie Policy accessible from the footer of the Site.

ARTICLE 6 – OBLIGATIONS OF THE USER

The User undertakes to:

  • Use the Site in accordance with the laws in force and these GTCU;
  • Not attempt to fraudulently access protected areas (third-party accounts, back-office, databases, etc.);
  • Not hinder or disrupt the proper functioning of the Site;
  • Not infringe the rights of third parties or the security of the Site.

In the event of a breach of these GTCU, IRIS GALERIE reserves the right to restrict or suspend access to the Site, without prejudice to any legal action.

ARTICLE 7 – LIABILITY

IRIS GALERIE implements all reasonable means to ensure reliable and continuous access to the Site.

However, its liability cannot be engaged:

  • In the event of a momentary interruption for maintenance, update or force majeure;
  • In the event of malfunction, breakdown or technical incompatibility affecting the User;
  • In the event of inappropriate or unlawful use of the Site by the User.

ARTICLE 8 – MODIFICATIONS TO THE GTCU

IRIS GALERIE reserves the right to modify these GTCU at any time.

The updated versions will be published on the Site, with the corresponding update date. The User is invited to consult this page regularly.

Continued use of the Site constitutes acceptance of the modified GTCU.

ARTICLE 9 – APPLICABLE LAW AND JURISDICTION

These GTCU are governed by French law.

In the event of a dispute relating to the interpretation or performance of these GTCU, the competent courts shall be those within the jurisdiction of the registered office of IRIS GALERIE SAS, unless mandatory legal provisions provide otherwise.
